Former Quezon City Mayor Herbert Bautista and his ex-aide Aldrin Cuña have been convicted of graft by the Sandiganbayan. 

The court found them guilty of the 2019 procurement of an Online Occupational Permitting Tracking System (OOPTS).

The case involved P32 million in public funds, which were already received by a private company not involved in the trial.

Neither Bautista nor Cuña were fined as the funds were not directly traceable to them.

Ex-QC mayor Herbert Bautista convicted of graft by Sandiganbayan

In April 2023, the Office of the Ombudsman filed two graft cases against Bautista before Sandiganbayan.

The first case was over the P32 million online permitting and tracking system, which did not have a specific appropriation ordinance enacted by the Sangguniang Panglungsod.

The two also faced another graft charge over releasing P25.3 million of public funds to install a solar power system and waterproofing works for a civic center building to Cygnet despite the company failing to secure a net metering system from Meralco.

In November 2023, Bautista, Cuña, and Geodata Solutions, Inc.

CEO Alberto Morales pleaded not guilty to a graft charge over the purchase of a P16 million hospital information system.

Guilty ang hatol ng Sandiganbayan sa kasong graft laban sa aktor at dating alkalde ng Quezon City na si Herbert Bautista.

Ito ay kaugnay sa maanomalyang procurement ng Online Occupational Permitting and Tracking System (OOPTS), na nagkakahalaga ng PHP32.1 million, noong 2019.

Kasama ni Bautista na nahatulang guilty ang dating city administrator na si Aldrin Cuña.

Sinentensiyahan ng anim na taon at isang buwan hanggang sampung taong pagkakakulong sina Bautista at Cuña.

Bukod pa rito, kasama sa hatol ang "perpetual disqualification from holding public office."

Ibig sabihin nito, hindi na maaring tumakbo o humawak ng anumang posisyon sa gobyerno ang dalawa.

Tatlong terminong umupo si Bautista bilang alkalde ng Quezon City, mula taong 2010 hanggang 2019.

Sandiganbayan's decision

Ngayong Lunes, January 20, 2025, ibinaba ng Special Seventh Division ng anti-graft court ang kanilang desisyon sa kaso nina Bautista at Cuña.

Ayon sa Sandiganbayan, nilabag nina Bautista at Cuña ang Section 3 ng Republic Act No.

3019 o Anti-Graft and Corrupt Practices Act.

Nakasaad sa dokumento ng Special Seventh Division (published as is): "In Quezon City, the old system of applying and paying for occupational permits' required the physical presence of an applicant in the City Hall which often resulted in serpentine queues and exposure to the elements.

The vote is two (2) against one (1) - meaning there exists a cloud of doubt even among the Justices who deliberated on the evidence presented in this case.

"We likewise believe that the pieces of evidence of both sides do not support any finding of guilt against the former Mayor.

"It was established during trial that the Project itself was duly delivered to and received by the Quezon City Government, and therefore, the payment to the supplier was valid.

It is not imposed as a result of judicial proceedings.

In a six-page resolution issued on April 3, 2024,  the anti-graft court said that the criminal charge filed against Cuña is "sufficient in form and substance," and, thus, the issuance of the suspension is only a matter of course.

"This is because a preventive suspension is not a penalty.

HERBERT BAUSTISTA'S CAMP RELEASES STATEMENT

Ayon sa legal counsel ng acor-politician, ikinalungkot at ikinadismaya nila ang naging hatol ng korte sa anila'y mapanirang alegasyon na hindi naman daw totoo.

Saad ng kampo ng dating alkalde: "We are deeply saddened by the verdict of the Seventh Division of the Sandiganbayan against our client, Former Quezon City Mayor Herbert Constantine M.

Bautista.

"We strongly believe that our client is innocent of the malicious charge against him.

"He did not commit any act which constitutes the offense charged.

"Change came in 2019 when the Quezon City Government procured an Online Occupational Permitting Tracking System (alternatively, OOPTS or Project) which pivoted to a fully online digital platform.

"Applying these rules, the penalty that shall be imposed on the accused found liable is imprisonment for a minimum period of six years and one month and a maximum period of ten years.

In fact, if acquitted, the official concerned shall be entitled to reinstatement and to the salaries and benefits which he failed to receive during suspension," the resolution stated.

"Taking into consideration the public policy involved in preventively suspending a public officer charged under a valid information, the protection of public interest will definitely have to prevail over the private interest of the accused," it also stated.

The resolution was written by Presiding Justice Amparo M.

Cabotaje-Tang with the concurrence of Associate Justices Bernelito R. Fernandez and Ronald B. Moreno.

Prosecutors alleged that Cuña, who was then city administrator of Quezon City at that time, together with former Mayor Herbert "Bistek" Bautista, made the full payment of P25,342,359.25 to Cygnet Energy and Power Asia, Inc. for the Supply and Installation of Solar Power System and Waterproofing Works for the city's Civic Center Building.

However, the prosecutors alleged that Cygnet was not entitled to the said amount due to its failure to get the Net Metering System from Meralco, which is a requirement of the Supply and Delivery Agreement.

Bautista and Cuña also have aanother case before the Sandiganbayan over the payment made to Geodata Solutions Inc.
