Mike De Luca Jr., the victim’s son, said he continues to be frustrated with the District Attorney’s Office and was not surprised by the report’s conclusion.
“It is apparent to me the officers made a human error,” he said in a statement, adding that he has no malice toward them.
“Nothing will bring my father back but his spirit is with me every day and it’s time for all involved to try and heal,” the victim’s son said.
A request for comment to the Port Hueneme Police Department was not returned.

(AP) Prosecutors say the 2013 shooting death of a former boxer and bodyguard for Sylvester Stallone by Ventura County police officers was justified.Michael De Luca was killed in September 2013 by two Port Hueneme (Wye-NEE’-mee) officers responding to a report of a traffic collision in a beach parking lot.
The District Attorney’s Office said Tuesday in a report that 53-year-old Michael De Luca was not complying with officers’ orders to stay in his vehicle, and both officers said he seemed impaired.
The report says the 53-year-old De Luca announced he had a weapon and pointed his hand like a gun toward the officers while on the ground in the dark.
No gun was found.

The 2013 shooting death of a former Thousand Oaks boxer and bodyguard for Sylvester Stallone by two Port Hueneme police officers was justified, the Ventura County District Attorney’s Office said Tuesday in a report.
Michael De Luca, 53, was killed sometime after 4:15 a.m.
