That’s according to The Daily Tribune News, which reports the order was filed late last week in Bartow County Superior Court for the trial of Austin Levi Payne and Brandy Ann Boyd.

A Bartow County jury has convicted a mother and her boyfriend in the death of the woman’s child.


The 25-year-old attended Cass High School and Kennesaw State University. 'It's supposed to be your natural instinct as mother to protect her.'

After their son was found dead, they said they always had to fight to see their grandchild every month.

Sometimes, they saw bruises, they said.

Boyd 'explained it away, said she fell and hit her head on the bed', Mr Hunt said.

The Hunts are now trying to get custody of Journey Ann's remains so they can bury her next to their son.

Boyd, from Cartersville, lists on her Facebook profile her job as 'Mommy' at 'I Love Being a Mom'.

Journey Ann Cowart died at Cartersville Medical Center on Jan.

21, 2014, after she was taken to the emergency room because she was not breathing.

Bartow County Sheriff Clark Millsap previously told The Atlanta Journal-Constitution that Journey was beaten to death, with “a fractured skull, blunt force trauma to the stomach.” He also said there was evidence of previous abuse.

The pair were initially charged with first-degree cruelty to children and aggravated battery, but the charges were upgraded after an autopsy revealed the extent of Journey’s injuries.

The murder trail got underway last week, and the state and defense rested their respective sides earlier this week. “This was a difficult case and the District Attorney’s office appreciates the service of the jury, their openness to hear the facts of the case and their willingness to hold those responsible for Journey’s death accountable.”

Boyd and Payne were arraigned in November and both entered not guilty pleas to the charges.


Following the service, Journey's paternal grandparents, Mellodie and Allen Hunt, told CBS Atlanta that they were still stunned at the child's death.

'I can't wrap my mind around that someone did that to a baby,' Mrs Hunt said. Both defendants were granted a $1 million bond in May 2014.

Together, Boyd and Payne face four counts each of malice murder, six counts of felony murder, three counts of aggravated battery and one count of battery.

The latest order comes on the heels of Judge Carey Nelson rejecting a change of venue request to have the trial moved out of Bartow County and issuing a gag order in the case.

The defendants were arraigned in November and both entered not guilty pleas to the charges.

According to the order, jurors will be transported from a designated parking area to the courthouse each day of the trial, which is expected to begin on Monday, the Tribune notes.

Jurors will also not have cell phones, electronic devices or any written materials ”except those furnished by the court.” Additionally, jurors will be escorted by at least one bailiff or sheriff’s deputy during recesses and breaks for meals.

A mother and her boyfriend have been charged with murder after her daughter was beaten to death just days after first birthday.

Brandy Ann Boyd, 25, and Austin Levi Payne, 24, both of Cartersville, Georgia, were arrested three days after Journey Ann Cowart was rushed to the hospital, not breathing, on January 21.

But on Monday, their charges were upgraded to murder, after autopsy results allegedly showed it was not the first time the little girl had suffered at the hands of her carers.

'A fractured skull, blunt force trauma to the stomach,' Sheriff Clark Millsap told the Atlanta Journal Constitution of the autopsy results.
